Updated July 24, 2026. Quick answer: Idaho exempts Social Security and taxes essentially everything else at a flat 5.3% — cut from 5.695% by HB 40 (2025), a figure many guides haven’t caught up with. Pensions, 401(k) and IRA withdrawals get no general exclusion; the state’s Retirement Benefits Deduction (Idaho Code §63-3022A) is far narrower than its name suggests — it covers CSRS but not FERS federal retirees, military retirement, and a short list of Idaho police and firefighter funds, and is reduced by Social Security received. No estate or inheritance tax.

The CSRS-not-FERS trap (and the 2025 changes)

Idaho’s §63-3022A deduction reads like a broad retiree benefit and isn’t: it applies only to Civil Service Retirement System annuities (the pre-1987 federal system — FERS retirees do not qualify), the Foreign Service system, military retirement, the Idaho Firefighters Retirement Fund, and certain Idaho police pensions — and what it grants, it offsets by Social Security benefits received. Two 2025 updates worth dating: HB 40 cut the flat rate to 5.3%, and eligibility expanded so retired servicemembers under 62 can qualify if disabled or employed within income limits. A private-sector retiree gets none of this — every 401(k) dollar is taxed at 5.3%.

Idaho is a UPC state — compensation is “reasonable” (Idaho Code §15-3-719), no percentage schedule. Small estates: up to $100,000 of personal property (net of liens) passes by affidavit (Idaho Code §15-3-1201) after a 30-day wait; summary procedures are also available for a surviving spouse. Middling by design: Social Security rides free, but the flat 5.3% on all withdrawals — with no age-based exclusion — puts Idaho behind neighbors like Wyoming and Nevada (no income tax) and Utah (4.45% with an SS credit) for portfolio retirees, while CSRS and military retirees do meaningfully better. No death taxes and clean UPC probate keep the estate side simple. The 5.3% figure itself is the thing to get right — plenty of coverage still quotes 5.695% or even 5.8%.

What probate costs in Idaho

Idaho sets probate compensation by a “reasonable fee” standard with no percentage schedule, so anyone quoting a firm figure is estimating. And the small-estate shortcut of $100,000 does not clear a solely owned house on its own, which is the detail most guidance omits.
