Updated July 24, 2026. Quick answer: Wyoming taxes no income of any kind — Social Security, pensions, 401(k) and IRA withdrawals all untaxed — and levies no estate or inheritance tax. Two probate facts complete the picture, one great and one worth planning around: the small-estate limit doubled to $400,000 on July 1, 2025 (SF0104), among the most generous in the nation — but estates above it face statutory percentage fees for both the personal representative and the attorney, each on the same schedule.

The $400,000 affidavit (SF0104 — the 2025 change most guides missed)

Effective July 1, 2025, Wyoming’s 2025 SF0104 (Enrolled Act 85) doubled the small-estate ceiling from $200,000 to $400,000: estates under the line can use distribution by affidavit (Wyo. Stat. §2-1-201) or summary procedures and skip formal probate entirely — a threshold that now covers a large share of Wyoming estates outright. Guides still quoting $200,000 are a year stale.

Above the line: a double fee schedule

Formal Wyoming probate carries statutory percentage fees for the personal representative and the estate’s attorney — each computed on the same schedule (PR: Wyo. Stat. §2-7-803; attorney: §2-7-804): 10% of the first $1,000; 5% of the next $4,000; 3% of the next $15,000; 2% above $20,000, plus court-allowed extraordinary fees (parties may negotiate less). Worked example — $600,000 probate estate: about $12,350 per role, roughly $24,700 combined — on an estate that owed Wyoming no tax at all. The planning takeaway mirrors Nevada and California: keep the estate under the affidavit line or out of probate via trust and beneficiary designations, and the fee schedule never applies.
