The deferral trap
Virginia lets qualifying seniors defer property tax. A deferral is not relief in the ordinary sense: the tax is still owed, it accumulates, and it is typically secured against the home and repayable when the owner dies, sells or moves out. Where a locality adopts a deferral ordinance, Va. Code 58.1-3216 makes accumulated deferred taxes plus interest (capped at 8% a year) a lien on the real estate, due on sale, a non-qualifying transfer, or from the decedent’s estate within one year of the last qualified owner’s death. For a homeowner whose plan is to leave the house to their children that matters enormously — the heirs inherit the debt with the property.
