Does Wyoming Tax Trust Income? (2026)

Updated October 5, 2026. Quick answer: No. Wyoming does not tax trust income at the state level: a Legislative Service Office table of Wyoming tax rates lists the individual income tax at 0% and shows $0 in collections for the most recent year listed.

How Wyoming treats trust income

ItemWhat the documents say
TreatmentA June 2025 Wyoming Legislative Service Office presentation lists Wyoming’s individual income tax rate as zero, with a note pointing to Article 15, Section 18 of the Wyoming Constitution. The source says: “Individual Income Tax 0% (Note Art. 15, Sec. 18)”. The table does not mention trusts.
Where the constitution speaksArticle 15, Section 18 of the Wyoming Constitution does not ban an income tax outright. As reproduced in a legislative staff draft, it says “No tax shall be imposed upon income without allowing full” credit against such tax liability for sales, use and ad valorem taxes paid in the year. The staff draft notes the section is not repealed.
Rate on trust incomeNo state income tax rate applies to trust income in the documents read, so no trust rate schedule exists there.
Distribution deductionWith no state income tax rate shown for individuals or trusts, the documents read describe no state distribution deduction.
Nonresident trustsThe documents read say nothing about how nonresident trusts are treated by Wyoming.
Return to fileThe documents read describe no Wyoming income tax return for trusts or individuals.
What the documents do not sayNeither document names trusts or estates in connection with Wyoming income tax, so the treatment of trusts rests on the zero individual rate and not on a trust specific statement.

A $10,000 example

A trust with $10,000 of taxable income owes $0 of Wyoming income tax on it. Federal tax on the trust’s income still applies.

A trust with ties to another state also has to check that state’s own rules, because each state sets its own test for taxing a trust.

What changes in 2026

The latest documents read print no 2026 change to how trust income is taxed.

Federal rules

The state’s treatment sits on top of the federal one. The federal brackets a trust faces are laid out in trust tax brackets versus individual brackets, and capital gains that a trust keeps are covered in capital gains stay in the trust. The IRS explains the federal return in the About Form 1041 page.
