Updated September 24, 2026. Quick answer: A revocable living trust drawn up by a Wyoming attorney runs a median $2,500, $2,100–$2,900 for the middle half of the 909 firms LegalTemplates surveyed in 2026. That puts Wyoming at the 9th-cheapest of the 20 states compared here, coming in over the $2,475 national median for a standalone trust. A DIY platform runs $149 to $649. What that spend buys locally: Wyoming charges $110.00 to file for probate, plus a $40.00 court automation fee and a $10.00 indigent legal services fee, for $160.00 total.
Whether the state taxes the trust’s income is a separate question: does Wyoming tax trust income.

What a living trust avoids: probate in Wyoming
Wyoming’s probate system is what a funded trust bypasses entirely; here is what that system actually charges. Wyoming charges $110.00 to file for probate, plus a $40.00 court automation fee and a $10.00 indigent legal services fee, for $160.00 total. Full filing-fee breakdown.
Wyoming puts probate fees on a statutory percentage schedule, so the largest single cost is anchored to published numbers rather than to an hourly rate: the personal representative and the estate attorney follow the same statutory schedule; 10% of the first $1,000, 5% of the next $4,000, 3% of the next $15,000 and 2% above $20,000 of estate value (Wyo. Stat. §2-7-803 and §2-7-804); and parties may negotiate lower. The second number is the small-estate threshold, at or under which an estate skips most of probate: $400,000, raised from $200,000 in 2025, and it reaches real property. Whether any of that reaches a solely owned house is answered below; it is where most published guidance goes wrong. Wyoming living trust: signing, notary and the deed
Each line is a short extract quoted from, or a plain summary of, the statute cited; the section has the exceptions.
- Writing rule. Wyo. Stat. § 4-10-408 (summarized, not quoted): a trust need not be evidenced by a trust instrument unless another statute requires one, but an oral trust and its terms can be established only by clear and convincing evidence.
- Deed and notary. Wyo. Stat. § 34-1-106: “…executed and acknowledged by the party from whom or which the estate…”
- Certification of trust. Wyo. Stat. § 4-10-1014: “…the trustee may furnish to the person a certification…”

Funding the trust in Wyoming
The trust protects only what is actually inside it, which for real estate means a recorded deed change, not just the trust paperwork. Funding the trust in Wyoming costs nothing on the tax side: Wyoming has never enacted a real estate transfer tax, and no such tax appears anywhere in current Wyoming statute, so a deed into your own revocable trust triggers no state levy. Wyoming also has no change-in-ownership reassessment system: Wyoming Department of Revenue, Property Tax Division guidance requires all taxable property to be valued annually at fair market value by the county assessor regardless of title changes, not by a per-transaction trigger. The new deed still has to be recorded with the county clerk along with a Statement of Consideration, for a modest per-page fee.
