What the Kansas documents say
The Department of Revenue’s Notice 08-01 is headed Kansas Inheritance Tax Ends On July 1, 2008. It says the tax “applies to the estates of decedents dying before July 1, 1998”, so for any later death there is nothing to pay.
Notice 10-07 says the Kansas estate tax, which had replaced it, was repealed too: there is “no estate tax for estate of decedent’s dying after December 31, 2009”.
What an heir in Kansas still faces
The federal estate tax is paid by the estate, with a 2026 basic exclusion amount of “$15,000,000 for calendar year 2026”. Kansas has no estate tax now either: Notice 10-07 says there is “no estate tax for estate of decedent’s dying after December 31, 2009”. CMG’s Kansas estate tax page covers it.
An heir’s basis under 26 U.S.C. 1014(a) is generally the value at “the date of the decedent’s death”. Inherited retirement money is an income tax question: see Kansas 401(k) and IRA withdrawals and the inherited IRA RMD calculator.
How current the Kansas documents are
Read on October 5, 2026: Notice 08-01: Kansas Inheritance Tax Ends On July 1, 2008 (Kansas Department of Revenue, dated 2008); Notice 10-07: Kansas Estate Tax Repealed for Estates of Decedents Dying on or after January 1, 2010 (Kansas Department of Revenue, dated 2010).
What the documents do not say
- Both Kansas documents are Department notices from 2008 and 2010, the Department’s own statements of the repeals; this page relies on no later Kansas document.
Common mistakes
- Reading the 1998 cutoff as a Kansas death tax on later estates; the inheritance tax applied only to deaths before July 1, 1998 and ended July 1, 2008.
