Updated August 10, 2026. Quick answer. North Carolina life insurance policies carry a free-look period of 10 days (‘Ten Day Free Look’), and a grace period of 31 days before a missed premium lapses the policy. If the insurer fails, North Carolina Life and Health Insurance Guaranty Association is the backstop, subject to statutory caps below.

The free-look period

10 days (‘Ten Day Free Look’)

The clock runs from: receipt of the policy by the policyholder.

Extended window: 30 days for replacement policies and contracts (11 NCAC 12 .0612(4))

The grace period before a lapse

31 days

Runs from: the due date of any premium except the first.

Coverage during the grace period: the death benefit coverage shall continue in force; the policy may provide that if a claim arises during the grace period, the amount of any premium due or overdue may be deducted from any amount payable under the policy in settlement

If the insurer fails: the guaranty association limits

North Carolina Life and Health Insurance Guaranty Association is North Carolina’s backstop if a life insurer becomes insolvent — but it pays up to a statutory cap, not the full policy value.

BenefitLimit
Death benefit$300,000
Cash surrender valueNot established by a general statute — see notes (North Carolina sets no separate cash-surrender/cash-value sublimit — it has no analogue to the model act’s $100,000 carve-out. Cash values are expressly included inside the single $300,000 ‘for all benefits, including ca)

Read the cap as a coinsurance percentage AND a dollar ceiling, whichever binds first — many states apply both (commonly 80% of the contractual value, capped at a flat dollar figure), so a large policy can lose more than the percentage alone suggests.
