Florida Life Insurance Rules: Free-Look, Grace Period, Guaranty Limits

Florida life insurance policies carry no general free-look mandate located for ordinary individual life insurance (see the extended-window exception below), and a grace period of Not less than 30 days before a missed premium lapses the policy. If the insurer fails, Florida Life and Health Insurance Guaranty Association (FLAHIGA) is the backstop, subject to statutory caps below.

The free-look period

The grace period before a lapse

Coverage during the grace period: The policy continues in force during the grace period; if the policy becomes a claim during the grace period before the overdue premium (and the current policy year’s deferred premiums, if any) is paid, the amount of such premium or premiums with interest not in excess of 8 percent per year may be deducted in any settlement under the policy

If the insurer fails: the guaranty association limits

Florida Life and Health Insurance Guaranty Association (FLAHIGA) is Florida’s backstop if a life insurer becomes insolvent — but it pays up to a statutory cap, not the full policy value.

Read the cap as a coinsurance percentage AND a dollar ceiling, whichever binds first — many states apply both (commonly 80% of the contractual value, capped at a flat dollar figure), so a large policy can lose more than the percentage alone suggests.
