2026 edition · statute-cited · part of Clear Money Guide’s 51-state retirement tax series. This guide covers state taxes on retirement income and estate transfers; property and sales taxes vary by county and are outside its scope.

Updated July 24, 2026. Quick answer: South Dakota taxes none of it: no state income tax — Social Security, pensions, 401(k) and IRA withdrawals all untaxed — no estate tax, and no inheritance tax. Among the no-tax states it is arguably the cleanest package for retirees: probate runs on the Uniform Probate Code’s reasonable-compensation standard (default percentage commissions apply only when a will is silent or the estate is intestate), and an estate of $100,000 or less after liens and encumbrances can collect personal property by affidavit.

Settling an estate: UPC simplicity and a $100,000 affidavit

South Dakota is a Uniform Probate Code state: personal-representative compensation is “reasonable” (SDCL §29A-3-719), attorney fees likewise. The only percentages are optional default commissions on personal property when a will is silent or the estate is intestate (5% on the first $1,000, 4% up to $5,000 and 2.5% above that), with compensation on real property fixed by the court. Small estates: thirty days after the death, a successor can collect the decedent’s personal property by affidavit when the value of the entire estate, wherever located, less liens and encumbrances, does not exceed $100,000 (SDCL §29A-3-1201). The affidavit must also state that no application or petition for the appointment of a personal representative is pending or has been granted in any jurisdiction, and that the decedent has not incurred any indebtedness to the Department of Social Services for medical assistance for nursing home or other medical institutional care. Real property has its own affidavit: sixty days after the death, for a decedent’s interest in South Dakota real property that does not exceed fifty thousand dollars (SDCL §29A-3-1203). Context: probate cost by state · small-estate limits by state.

Is South Dakota a good state to retire in for taxes?

Yes, with no asterisks in the tax code itself: zero on income, zero at death, a reasonable-compensation standard at probate, and a six-figure affidavit lane. South Dakota’s trust industry exists precisely because the state pairs no income tax with settlor-friendly law — retirees benefit from the same fundamentals without needing a dynasty trust. As with every no-tax state, the decision comes down to non-tax factors: climate, distance to family, healthcare access. The tax section of that decision is already settled.

What probate costs in South Dakota

South Dakota sets probate compensation by a “reasonable fee” standard (default percentage commissions apply only when a will is silent or the estate is intestate), so anyone quoting a firm figure is estimating. The $100,000 limit applies to the value of the entire estate, wherever located, so a house counts toward it, and the separate real-property affidavit is limited to a decedent’s interest in South Dakota real property of fifty thousand dollars or less (SDCL §29A-3-1203).
