Updated August 19, 2026. Quick answer: West Virginia sets the personal representative’s commission by statute (W. Va. Code §44-4-12a): 5% of the first $100,000, 4% of the amount above $100,000 up to $400,000, 3% of the amount above $400,000 up to $800,000 and 2% above $800,000 of the personal estate received and accounted for and of the proceeds of real estate sold, plus 1% of the value of real estate not sold, so the commission grows with the size of the estate. The second number is the small-estate threshold, at or under which an estate skips most of probate: $50,000 of personal property, and only where the decedent owned no probate real estate, by affidavit. The county commission may deny or reduce the statutory commission if the personal representative has not faithfully discharged the duties, or increase it for extraordinary services (W. Va. Code §44-4-12a(d)). Whether any of that reaches a solely owned house is answered below — it is where most published guidance goes wrong.

What the fee is calculated onW. Va. Code §44-4-12a: personal representatives are allowed reasonable expenses and commissions on the personal estate received and accounted for and on the proceeds of real estate sold: 5% of the first $100,000, 4% of the amount above $100,000 up to $400,000, 3% of the amount above $400,000 up to $800,000 and 2% above $800,000, plus 1% of the value of real estate not sold. The county commission may reduce, deny or increase the commission, and a testator may set a different commission in the will.

Small-estate thresholdSmall Estates Act as amended by HB 2867 (2025), effective July 9, 2025: affidavit process without PR appointment where probate personal property (‘small assets’) is $50,000 or less AND the decedent owned no probate real estate. An estate with probate real property, or with an interest in probate real property, is precluded from the small-estate route (W. Va. Code §44-1A-2(a) and (b); item 6 of the statutory affidavit form swears to it). Read at code.wvlegislature.gov, 20 August 2026.

Why West Virginia has no single answer

West Virginia publishes a percentage schedule for the personal representative’s commission in W. Va. Code §44-4-12a, so that part of the bill can be computed from the estate’s value. What the statute actually fixes is the commission: W. Beyond that commission, three things decide the rest of the bill — how many billable hours the administration takes, whether any beneficiary contests, and whether the estate qualifies for the small-estate route below and skips most of it. Get the fee basis in writing before engaging anyone.

What is the small estate limit in West Virginia?

Small Estates Act as amended by HB 2867 (2025), effective July 9, 2025: affidavit process without PR appointment where probate personal property (‘small assets’) is $50,000 or less AND the decedent owned no probate real estate. An estate with probate real property, or with an interest in probate real property, is precluded from the small-estate route (W. Va. Code §44-1A-2(a) and (b); item 6 of the statutory affidavit form swears to it). Read at code.wvlegislature.gov, 20 August 2026.

This state’s small-estate route cannot reach real property at all. Since July 9, 2025 an estate that includes probate real estate is precluded from the route outright (HB 2867 (2025), amending W. Va. Code §44-1A-2), so a solely owned house means a full administration whatever the estate is worth.

Does a house have to go through probate in West Virginia?

Usually yes, if the house was solely owned. West Virginia’s small-estate route cannot reach real property at all: since July 9, 2025 owning probate real estate precludes the route outright, so a solely owned house means a full administration whatever the estate is worth. How West Virginia compares to the other 50

West Virginia’s small-estate threshold of $50,000 ranks 28 of 49 jurisdictions with a stated figure, and sits close to the national median of $75,000. The range runs from $15,000 at the bottom to $400,000 at the top, so where an estate falls relative to the line matters far more than any national “average probate cost” figure. On fee model, West Virginia uses a statutory percentage commission schedule for the personal representative (W. Va. Code §44-4-12a), not the reasonable-fee approach.

Death taxes in West Virginia, separately

West Virginia levies neither an estate tax nor an inheritance tax, which is true of 34 jurisdictions. That is a different question from probate cost and is decided by different statutes, but families routinely conflate the two.

What this does not include

The figures above are the probate cost — the court and compensation side of settling an estate. They are separate from any state estate tax or inheritance tax, which are taxes on the transfer itself and are owed whether or not the estate goes through probate. Appraisal, bond premium, publication, and real-estate commissions if property is sold are additional and are not set by the fee statute.

Before you hire anyone

  • Ask which statute the fee is charged under, and get the citation. In West Virginia the governing provisions are below.
  • Ask whether the quoted fee is calculated on gross value or net of debts. Gross-value states charge on the full house value even if a mortgage covers most of it.
  • Ask whether the personal representative is also claiming compensation, and on what basis.
  • Ask in writing whether the estate qualifies for the small-estate route, and if a solely owned house is involved, whether that route reaches it.

Probate cost is one of four things West Virginia decides for a retiree and their heirs. The other three — income tax on withdrawals, estate tax, and inheritance tax — are priced separately:

What the whole settlement costs here. The personal representative’s commission follows the statutory percentage schedule in W. Va. Code §44-4-12a. No state estate tax and no inheritance tax reaches an estate this size here. The small-estate route stops at $50,000 and it does not reach real property: owning probate real estate precludes the route outright since July 9, 2025. No state charges estate tax at any of these estate sizes. All three lines computed for every state: the cost of dying index.

What the executor can be paid here. West Virginia sets executor compensation at W. Va. Code §44-4-12a, and the leaf works it out on $100,000, $500,000 and $1,000,000 estates: executor fee in West Virginia.
