Residency before filingRCW 26.09.030 lets a party who is a resident of Washington (or stationed here in the armed forces, or married to such a person) petition for dissolution, and RCW 26.09.010 says a dissolution case may be filed in the superior court of the county where the petitioner resides.
Waiting periodWhere the petition alleges that the marriage is irretrievably broken, the court proceeds once ninety days have elapsed since the petition was filed and since service of summons or first publication of summons: it enters a decree if the other party joins or does not deny that the marriage is irretrievably broken, and takes further steps if the other party denies it.
Settlement agreementSpouses may make a written separation contract covering maintenance, property, the parenting plan and child support; it binds the court unless found unfair when made (parenting plan terms excepted), and is set forth in the decree, or filed in the action or made an exhibit and incorporated by reference, unless the contract says otherwise (the parenting plan terms must in all cases be set out in the decree).

Where a settlement agreement fits

Spouses may make a written separation contract covering maintenance, property, the parenting plan and child support; it binds the court unless found unfair when made (parenting plan terms excepted), and is set forth in the decree, or filed in the action or made an exhibit and incorporated by reference, unless the contract says otherwise (the parenting plan terms must in all cases be set out in the decree).

The text itself:

  • RCW 26.09.070 Separation contracts: “may enter into a written separation contract”
  • RCW 26.09.070 Separation contracts: “shall be binding upon the court unless it finds”
  • RCW 26.09.070 Separation contracts: “agreement shall be set forth in the decree of dissolution”

What the documents do not say

  • Whether the court system offers these forms free of charge: not found in the documents read.
  • The filing fee shown is one county’s published figure; other Washington counties publish their own.
  • The sections of RCW 26.09.030 read state that the petitioner must be a resident but print no minimum length of residence.
  • Child custody, child support and property-division rules, and local court rules, were not read.

Common mistakes

  • Treating the one-county filing fee above as the fee in every Washington county.
  • Assuming the answer for one state applies to another, or that a form filled in correctly is the same as a form the court has accepted.
