Wyoming TOD Brokerage and Vehicle Registration: Yes, Allowed

Updated October 8, 2026. Quick answer: Yes, for securities and vehicles. Wyoming’s Uniform TOD Security Registration Act, W.S. 2-16-101 through 2-16-112, lets an owner register a security in beneficiary form, and it may be canceled or changed “without the consent of the beneficiary”. W.S. 31-2-104.1 separately allows a beneficiary designation form for a vehicle title.

How Wyoming handles transfer-on-death registration

ItemWhat the state documents say
Brokerage and securities accountsWyoming’s Uniform TOD Security Registration Act is codified at W.S. 2-16-101 through 2-16-112. It defines beneficiary form as a registration of a security that shows the present owner and the owner’s intention about who becomes owner at death. A registering entity includes a broker that maintains security accounts for customers. The source says: “includes a broker maintaining security accounts for customers”. A registering entity is not required to offer or accept a request for beneficiary-form registration, so the firm’s terms control availability.
Effect on the will and probateA transfer on death resulting from a registration in beneficiary form takes effect through the contract between the owner and the registering entity and the Act, and it is not testamentary. Ownership passes to the beneficiaries who survive all owners. The source says: “effective by reason of the contract regarding the registration”. Creditors’ rights against beneficiaries and other transferees under other Wyoming laws are not limited.
Changing the beneficiaryThe designation has no effect on ownership until the owner’s death, and the sole owner or all then surviving owners may cancel or change the registration at any time. The beneficiary has no say while the owner is alive.
Vehicle titlesWyoming allows an owner or owners of a vehicle to arrange for the title to pass to a named beneficiary at death using a beneficiary designation form that each county clerk makes available, under W.S. 31-2-104.1, created in 2025. The form carries the words transfer on death to, followed by the beneficiary’s name, and the notarized signature of all owners, and it is recorded with the county clerk where the vehicle is titled. The source says: “is a nonprobate transfer pursuant to the Wyoming Probate Code”. During the owner’s life the beneficiary’s signature or consent is not required, and the owner may revoke or change the designation at any time.

A $250,000 brokerage account split

An owner holds a brokerage account worth $250,000 and registers it in beneficiary form to two named beneficiaries, with each to receive half. Each share is computed as $250,000 x 50% = $125,000. The 50/50 split is the owner’s illustration, not a rule of the state: the owner names the beneficiaries and, where the form allows it, the shares.

Real estate, probate and estate tax

A transfer on death deed is a different instrument for real property: see Wyoming transfer on death deed. For what probate costs in Wyoming, see Wyoming probate cost, and for Wyoming’s own estate or inheritance tax, see Wyoming estate and inheritance tax. Which of these your account or vehicle falls under depends on how it is titled.

What changed recently

Wyoming created W.S. 31-2-104.1 in 2025 (Senate File 39, Enrolled Act 40) to allow a vehicle title to pass at death by beneficiary designation form.
