Updated September 24, 2026. Quick answer: Idaho attorneys charge a median $2,650 for a revocable living trust, LegalTemplates’ 2026 study of 909 firms found, with the middle half of quotes falling between $2,100 and $3,050. That puts Idaho at the 13th-cheapest of the 21 states compared here, coming in over the $2,475 national median for a standalone trust. A DIY platform runs $149 to $649. What that spend buys locally: Idaho charges a flat $166.00 statewide, whether the probate petition is formal or informal.
Whether the state taxes the trust’s income is a separate question: does Idaho tax trust income.

What a living trust avoids: probate in Idaho
Skip the trust and Idaho probate is the fallback route, with its own court bill attached, described below. Idaho charges a flat $166.00 statewide, whether the probate petition is formal or informal. Full filing-fee breakdown.
Idaho publishes no percentage schedule for probate compensation; the personal representative and the attorney are each paid what the court finds reasonable (Idaho Code §15-3-719), so the bill tracks hours worked rather than the size of the estate. The second number is the small-estate threshold, at or under which an estate skips most of probate: $100,000 of personal property, net of liens, by affidavit. Whether any of that reaches a solely owned house is answered below; it is where most published guidance goes wrong. Full Idaho probate cost guide, and the small-estate shortcut that can bypass probate even with no trust.
Idaho living trust: signing, notary and the deed
Each line is a short extract quoted from, or a plain summary of, the statute cited; the section has the exceptions.
- Writing rule. Idaho Code § 9-503 (summarized, not quoted): a trust or power concerning land can be created only by operation of law or by a conveyance or other instrument in writing signed by the party creating it, or by that party’s agent authorized in writing.
- Deed and notary. Idaho Code § 55-805: “…its execution must be acknowledged by the person executing it…”
- Certification of trust. Idaho Code § 68-114: “A trustee may present a certification of trust to any person…”

Funding the trust in Idaho
The paperwork does not end at signing. Real estate specifically has to be re-deeded into the trust’s name to actually be covered by it. Idaho keeps this simple by never taxing deed transfers in the first place: the state’s Revenue and Taxation title contains no real estate transfer or excise tax on deeds at all, so moving your home into your own revocable trust costs nothing beyond paperwork. Property tax works the same way: under Idaho Code §63-205, the county assessor values all property annually at market value as of January 1 regardless of who holds title, so a trust deed alone does not trigger a reassessment. Recording the new deed with the county recorder costs $15 for a deed of up to thirty pages under Idaho Code §31-3205(1)(b)(i).
