Updated September 23, 2026. Quick answer: Expect a median $3,650 for an attorney-drafted living trust in Georgia, per LegalTemplates’ 2026 survey of 909 law firms; the middle half of firms quoted $3,125 to $4,800. That is by far the highest median of the ten states compared here, roughly $900 above New York, the next-highest, and nearly $1,700 above Florida, the cheapest. A DIY platform runs $149 to $649. What that spend buys locally: Fulton County, Georgia’s most populous, charges $209 to file a petition to probate a will or to open administration without one.
Whether the state taxes the trust’s income is a separate question: does Georgia tax trust income.

What a living trust avoids: probate in Georgia
The payoff for the $3,650 spent on a trust shows up here: Georgia probate, and what it would otherwise cost the estate. Fulton County, Georgia’s most populous, charges $209 to file a petition to probate a will or to open administration without one. Full filing-fee breakdown.
Georgia’s default statutory commission for the personal representative is 2.5% of all sums of money received plus 2.5% of all sums paid out (O.C.G.A. §53-6-60) absent a will or agreement, while attorney fees are reasonable with no schedule at all. Funding the trust in Georgia
One step trips people up after the trust is drafted: retitling a house into it requires an actual new deed, not just the trust document. Georgia exempts a no-consideration deed to a trustee from its real estate transfer tax (O.C.G.A. §48-6-2(a)(9); see the Georgia Department of Revenue’s transfer tax page). Keeping the homestead exemption after the transfer typically means filing a homestead-for-trust affidavit with the county tax assessor, since the property is no longer titled in your own name. The deed still has to be recorded at the county Superior Court Clerk, for example $25 in Fulton County.
