Updated November 5, 2026. Quick answer: For taxable years beginning in 2027, the section 6039F amount that triggers reporting of gifts from certain foreign persons is $21,240.31, up from $20,573 for 2026, per IRS Rev. Proc. 2026-35, announced November 5, 2026. On Form 3520, that amount applies to gifts from foreign corporations and foreign partnerships; gifts from a nonresident alien individual or foreign estate have a separate $100,000 trigger.
The 2027 amount
Rev. Proc. 2026-35 states: “For taxable years beginning in 2027, § 6039F authorizes the Secretary of the Treasury or the Secretary’s delegate to require recipients of gifts from certain foreign persons to report these gifts if the aggregate value of gifts received in the taxable year exceeds $21,240.31.”
| Taxable years beginning in | Section 6039F foreign gift amount | Source |
|---|---|---|
| Statute base | $10,000 | 26 U.S.C. 6039F(a) |
| 2026 | $20,573 | Rev. Proc. 2025-32, item .47 of section 3 |
| 2027 | $21,240.31 | Rev. Proc. 2026-35, item .51 of section 3 |
The 2026 figure is from the prior Revenue Procedure: “the aggregate value of gifts received in the taxable year exceeds $20,573.” The increase is $667.31 (computed as $21,240.31 minus $20,573).
What section 6039F says
The statute starts from a lower base: “If the value of the aggregate foreign gifts received by a United States person” during a taxable year “exceeds $10,000, such United States person shall furnish” the information the Secretary prescribes about each foreign gift. The statute’s own figure is $10,000, and Rev. Proc. 2026-35 states the amount for taxable years beginning in 2027 as $21,240.31.
Which gifts it applies to on Form 3520
The Form 3520 instructions say a U.S. person files for the year if they received either: “More than $100,000 from a nonresident alien individual or a foreign estate (including foreign persons related to that nonresident alien individual or foreign estate) that you treated as gifts or bequests; or” “More than the section 6039F threshold amount from foreign corporations or foreign partnerships (including foreign persons related to such foreign corporations or foreign partnerships) that you treated as gifts.”
So the $21,240.31 figure is the one for the second kind of gift. The first kind has its own $100,000 trigger. Gifts are reported in Part IV: “Complete the identifying information on page 1 of the form and Part IV.” The part-by-part guide is Form 3520 Part IV, gifts and bequests from foreign persons, and a plain-language treatment of inheritances from abroad is foreign inheritances and Form 3520.
Common mistakes
- Applying $21,240.31 to a gift from an individual abroad. The instructions give a nonresident alien individual or foreign estate a separate $100,000 trigger.
- Using $20,573 for a 2027 tax year. That is the figure for taxable years beginning in 2026.
- Treating a foreign gift as taxable. The amount decides whether it is reported on Form 3520, not whether it is income.
