Does Oklahoma Tax Profit From Selling Your Home? (2026)

Updated October 8, 2026. Quick answer: Generally no, if you qualify for the federal exclusion. The 2025 packet says “Enter your Federal AGI from your federal return Form 1040”, which leaves out a gain excluded under section 121. Gain above it is taxed at graduated rates; for 2026 the Tax Commission’s legislative summary shows a top rate of 4.5%, and the deed carries a stamp tax.

What the Oklahoma documents say

The 2025 Form 511 packet tells resident filers to “Enter your Federal AGI from your federal return Form 1040”. Under the federal statute, “Gross income shall not include gain from the sale or exchange” of a principal residence that meets the ownership and use tests, so an excluded gain never enters federal adjusted gross income. That is reasoning from two documents. The packet prints no separate Oklahoma home-sale exclusion, and the Oklahoma pages read never name section 121.

The 2025 tax table ends with “$4,562 plus 0.0475 over $100,000” for single filers. The Tax Commission’s summary of 2025 legislation lists an “Individual income tax rate reduction, effective for tax year 2026”, and the 2026 withholding tables print a top rate of 4.5%.

The packet also has an Oklahoma capital gain deduction: “You can deduct qualifying gains receiving capital treatment” that are included in federal AGI. The gain must be earned on property in Oklahoma “that you have owned for at least five uninterrupted years” before the sale. Whether that deduction reaches gain on a main home is not settled by the lines read, so this page does not apply it.

What the federal exclusion requires

Most state answers start here. The statute says “Gross income shall not include gain from the sale or exchange” of property that, during the five years before the sale, you owned and used as your principal residence for periods adding up to two years or more. The limit is “shall not exceed $250,000”, or $500,000 for a husband and wife who make a joint return and meet the statute’s conditions. See CMG’s home sale taxes page and exclusion calculator.

A worked example at a $400,000 gain

An illustration, not a return: a married couple in Oklahoma sells their main home with a gain of $400,000 and meets the federal ownership and use tests. The gain is below the $500,000 joint exclusion, so it is not in federal adjusted gross income and, on the documents read, $0 is taxed by Oklahoma. As a second illustration, computed below, suppose the gain were $600,000. The amount above the exclusion would then be $100,000, which is taxed at the graduated rates; this page computes no tax because the bracket depends on the rest of the return.

What is collected at the sale

Oklahoma’s documentary stamp rule says “Stamps worth 75 cents must be affixed for each $500.00” of consideration, and the tax “shall be paid by either the grantee or the grantor”. That text is the 2023 rule and prints no principal-residence exemption. The documents read show no income tax withholding on a resident’s sale.

What changes in 2026

Oklahoma: the Tax Commission’s summary of 2025 legislation lists an individual income tax rate reduction effective for tax year 2026, with a top rate of 4.5% in the 2026 withholding tables.

What the documents do not say

  • The pages read never name section 121, so conformity is reasoned from the federal starting point. The 2026 top rate comes from the Tax Commission’s legislative summary and the withholding tables; the bill text was not archived. Whether the capital gain deduction reaches a main home is not settled by the lines read. The stamp tax rule is the 2023 text.

Common mistakes

  • Using the 2025 top bracket for a 2026 sale; the legislative summary lists a rate reduction effective for tax year 2026.
  • Treating the deed stamp tax as a tax on your profit; it is computed on the consideration, not on gain.
  • Assuming the answer for one state applies to another, or that the state answer changes the federal tax on the sale.
