Does Florida Tax Capital Gains? (2026)

Updated October 4, 2026. Quick answer: No. A capital gain is income, and the Florida Constitution says no tax upon “the income of natural persons who are residents or citizens” shall be levied by the state beyond the amounts that may be credited upon or deducted from a similar tax levied by the United States or any state. A sale of stocks, funds or real estate adds no Florida income tax.
