What it actually is

The regulation sets out when increased pension is payable… by reason of need for aid and attendance. So the structure is: qualify for pension first, then the increased rate applies on top if the medical criteria are met.
That structure is why so many people never claim it. They assess themselves against ‘a benefit for veterans needing care’, conclude it sounds like something else, and never reach the pension application it sits on.
The medical criteria, in the regulation’s own terms
The regulation lists what is considered in determining the need for regular aid and attendance: inability to dress or undress, or to keep oneself ordinarily clean and presentable; frequent need of adjustment of a prosthetic or orthopaedic appliance that cannot be done without aid; inability to feed oneself through loss of coordination or extreme weakness; inability to attend to the wants of nature; or incapacity requiring care or assistance on a regular basis to protect against hazards of the daily environment. Being bedridden is a proper basis in itself.
Two qualifications in the regulation’s own words matter enormously. It is only necessary that the evidence establish that the veteran is so helpless as to need regular aid and attendance, not that there be a constant need. And the determination must be based on the actual requirement of personal assistance from others. So round-the-clock care is not the test, and a diagnosis by itself is not the test either.
Aid and Attendance or Housebound — not both
How we know, stated honestly. The regulations do not contain a single sentence saying the two cannot be paid together. The exclusivity is structural: the section frames them as alternatives — by reason of need for aid and attendance, or if not in need of aid and attendance, by reason of being housebound — and the housebound rate is expressly for a veteran who is not in need of regular aid and attendance. We read that as establishing one rate or the other, and we are telling you it is an inference from the drafting rather than a quotable prohibition.
The money side
Because it is an increase to pension, the pension net worth rules govern eligibility — and there, uniquely, your income is counted inside your net worth rather than tested separately. Unreimbursed medical expenses can reduce countable income, which is often what brings a claimant under the limit; that is a calculation worth doing properly rather than estimating.
