Does Florida Tax Federal Pensions (FERS, CSRS)? 2026

Updated October 30, 2026. Quick answer: No. The Florida Department of Revenue says “The State of Florida does not have a personal income tax”, and the state Constitution limits any tax on the income of natural persons. That leaves a FERS or CSRS annuity untaxed by the state, though it is still on the federal return.

What Florida does with a FERS or CSRS annuity

QuestionWhat the Florida documents say
What the source saysThe Florida Department of Revenue says the state has no personal income tax. The Constitution limits any state tax on a natural person’s income, and the income tax code (chapter 220) is aimed at corporations and other artificial entities. None of these documents mentions federal civil service pensions.
Change for 2026No 2026 change is printed in the state documents cited here.

In the Florida documents’ own words

  • “a tax upon all corporations, organizations, associations, and other artificial entities” (Florida Statutes 220.02, Legislative intent (Income Tax Code))

How this differs from other pensions in Florida

The sources make no distinction between federal pensions and other pensions; the income tax code (chapter 220) is aimed at corporations and other artificial entities, not natural persons, so a federal pension is treated like any other income of a natural person. FERS, CSRS and your TSP

The state documents cited here do not address TSP withdrawals. For the Thrift Savings Plan itself, see Does Florida tax TSP withdrawals? and the TSP calculator.

Where this rule sits on the Florida return

Florida collects no individual income tax, so there is no state return to report an annuity on and no line to claim.

Checks before you rely on this answer

  • Confirm your move date if you moved to Florida during the year, because the other state may tax part of the year.
  • Keep reporting the annuity on your federal return as usual.
  • Check Florida’s other taxes, such as property tax, separately, because this page covers income tax only.

What the Florida documents leave open

The Department of Revenue page that states there is no personal income tax is a child support reporting page and does not mention pensions, CSRS, FERS or the TSP. Article VII, section 5 of the Constitution caps a tax on natural persons rather than banning it in its own words, and chapter 220 taxes corporations and other entities.

Common mistakes

  • Assuming no state tax means no tax at all. A taxable FERS or CSRS annuity is still on the federal return.
  • Keeping a former state’s rule in mind after a move. The state you live in decides which rule applies.
