Form 5329 Exception Code 12: Wrong Code on Form 1099-R

Updated October 17, 2026. Quick answer: Exception code 12 is for a distribution that Form 1099-R wrongly shows as an early distribution with code 1, J, or S in box 7, when you were actually age 59 1/2 or older. You enter the amount you received at that age on line 2 of Form 5329 and write 12 in the space provided. Line 2 then reduces the amount carried to line 3.

What exception code 12 means

The instructions list the code in one sentence: “Distributions incorrectly indicated as early distributions by code 1, J, or S in box 7 of Form 1099-R.” They then say what to put on the line: “Include on line 2 the amount you received when you were age 591/2 or older.”

Pub. 575 describes the same situation: “is incorrectly shown on your Form 1099-R for a distribution received when you were age 59 1/2 or older, include that distribution on Form 5329.” This page is about that single case. The wider list of exceptions is on early withdrawal penalty exceptions.

What the box 7 codes say

Pub. 590-B explains where the code sits: “A number or letter code in box 7 tells you what type of distribution you received from your IRA.”

It describes code 1 this way, in the number codes list: “Early distribution, no known exception”. The letter code that matches it for Roth accounts is described as “Early distribution from a Roth IRA or Roth SIMPLE IRA, no known exception”. The SIMPLE IRA code is described as “Early distribution from a SIMPLE IRA in the first 2 years, no known exception”. The Form 5329 instructions confirm the SIMPLE IRA letter: “These distributions are included in boxes 1 and 2a of Form 1099-R and are designated with code S in box 7.”

Pub. 590-B carries a caution for the early distribution codes: “If code 1, 5, or 8 appears on your Form 1099-R, you are probably subject to an additional tax.” Pub. 575 adds that if code 1 is incorrectly shown on your Form 1099-R for a distribution received at age 59 1/2 or older, you include the distribution on Form 5329 and enter exception number 12 on line 2. Each code is explained on the Form 1099-R box 7 codes page, and the early distribution codes have their own pages: code 1, code J and code S.

When you have to file Form 5329 for this

Pub. 575 explains who files: “Even if you don’t owe any of these taxes, you may have to complete Form 5329 and attach it to your Form 1040, 1040-SR, or 1040-NR.”

It gives the mismatch rule: “You should complete Form 5329 if you meet an exception to the tax on early distributions but box 7 of your Form 1099-R doesn’t indicate an exception.” For a distribution coded 1 that should not have been, the Pub. 575 passage above tells you to include it on Form 5329 and enter 12 on line 2.

How to claim it

The instructions for line 1 say what goes there for an ordinary distribution: “Enter the amount of early distributions includible in income”. Pub. 575 describes the first step for a distribution that should have an exception number: “Enter the taxable amount of the distribution shown in box 2a of your Form 1099-R on line 1 of Form 5329.”

How to enter it on line 2

The instructions for line 2 begin “Enter on line 2 the amount that you can exclude.” They continue “In the space provided, enter the applicable exception number”. The form’s own wording for line 2 reads “Enter the appropriate exception number from the instructions”. The earlier lines are covered on the Part I lines 1 to 4 page, and the other exceptions are compared on early withdrawal penalty exceptions. The whole form is mapped in Form 5329 explained.

Where it goes next

Line 2 feeds line 3. The form’s caption for line 3 reads “Amount subject to additional tax. Subtract line 2 from line 1”. Line 4 then reads “Additional tax. Enter 10% (0.10) of line 3.” The form continues “Include this amount on Schedule 2 (Form 1040), line 8”. The instructions say the same for a joint return: “Include the combined tax on Schedule 2 (Form 1040), line 8.” Schedule 2 is explained on the Schedule 2 page.

Edition and line numbers

This page reads the 2025 Form 5329 and its 2025 instructions, and the 2025-returns edition of the Publication where one is cited. These are the current files irs.gov served on 2026-10-17, and they are the forms for the tax year 2025 return, filed in 2026. Check the tax year printed on the form you are filling in and use the line numbers and exception numbers on that year’s form, because a different year’s form can number or word its lines differently.

Common mistakes

  • Using code 12 when you were under 59 1/2. The instructions limit it to “the amount you received when you were age 591/2 or older.”
  • Leaving the distribution off Form 5329 because the 1099-R is wrong. Pub. 575 says “include that distribution on Form 5329.”
  • Writing the wrong box 7 letter into the exception. The instructions name only “code 1, J, or S in box 7 of Form 1099-R.”
