Updated October 17, 2026. Quick answer: Form W-2 reports wages and withholding, and the employer files Copy A with Form W-3 and furnishes the other copies to employees. The 2026 General Instructions print one date for both jobs, February 1, 2027, and an extension to file is a single 30-day request on Form 8809 that is not automatic. An extension to file does not move the date for giving employees their copies.
Quick reference
| Item | As printed unless marked computed |
|---|---|
| Copy A and Form W-3 to the SSA | February 1, 2027, paper or electronic |
| Copies B, C and 2 to employees | February 1, 2027 |
| Extension to file (Form 8809) | one 30-day extension, not automatic |
| That extension counted from February 1, 2027 | March 3, 2027 (computed here, not published by the IRS) |
| Extension to furnish (Form 15397) | generally no more than 15 days, not automatic |
The February 1, 2027 deadline
The instructions print the date in the reminders: “The due date for filing 2026 Forms W-2, W-2AS, W-2CM, W-2GU, W-2VI, W-3, and W-3SS with the SSA is February 1, 2027, whether you file using paper forms or electronically.”
The When to file paragraph repeats it for the employer: “Mail or electronically file Copy A of Form(s) W-2 and Form W-3 with the SSA by February 1, 2027.” “You may owe a penalty for each Form W-2 that you file late.”
January 31, 2027 falls on a Sunday and the IRS prints Monday, February 1, 2027, so no date has to be worked out here. It is the same Monday that the Form 1099-NEC deadline page reaches for 1099-NEC forms by the next business day rule. The box-by-box meaning of what goes on the form is on the W-2 box 12 codes page.
The 30-day extension on Form 8809
The extension is narrow. The reminders say “Extensions of time to file Form W-2 with the SSA are not automatic.” “You may request one 30-day extension to file Form W-2 by submitting a complete application on Form 8809, Application for Extension of Time To File Information Returns”.
Form 8809 says the same from the form side: “Extension requests for Form W-2, Form 1099-NEC, and additional 30-day extensions are nonautomatic.” “For Forms W-2 or 1099-NEC, only one 30-day extension of time is available.” “Form 8809 must be filed by the due date of the returns.”
The When to file section adds the timing and the standard: “You must request the extension before the due date of Forms W-2.” “The IRS will grant extensions to file Forms W-2 only in limited cases for extraordinary circumstances or catastrophe, such as a natural disaster or fire destroying the books and records needed for filing the forms.” “No additional extension of time to file will be allowed.”
If the IRS grants the request, the instructions say “you will have an additional 30 days to file.” Counting 30 days from February 1, 2027 reaches March 3, 2027, a Wednesday. That date is computed here, not published by the IRS, and the Form 8809 instructions control the exact extended date.
What the extension does not extend
An extension to file does not move the employee deadline. The Caution reads: “Even if you request and are granted an extension of time to file Forms W-2, you must still furnish Forms W-2 to your employees by February 1, 2027.”
The reminders say the same thing: “This does not affect extensions of time to furnish Forms W-2 to employees.”
Employee copies have their own rule: “Generally, you must furnish Copies B, C, and 2 of Form W-2 to your employees by February 1, 2027.” “is properly addressed and mailed on or before the due date.”
A separate form requests more time to furnish: “You may request an extension of time to furnish Forms W-2 to employees by submitting a completed, signed Form 15397, Application for Extension of Time to Furnish Recipient Statements.” “Requests for an extension of time to furnish Forms W-2 to employees are not automatically granted.” “If approved, an extension will generally be granted for no more than 15 days from the due date, unless the need for up to a total of 30 days is clearly shown.” Fifteen days from February 1, 2027 is February 16, 2027, a Tuesday, computed here and not published by the IRS.
When employment ends early the dates shift. The instructions say “If employment ends before December 31, 2026, you may furnish copies to the employee at any time after employment ends, but no later than February 1, 2027.”
Penalties for late filing and late furnishing
The failure to file penalty depends on how late the correct form arrives. The instructions state that “The penalty amounts shown below apply to filings due after December 31, 2026.” That covers the 2026 forms due February 1, 2027.
| Timing | Penalty as printed for filings due after December 31, 2026 |
|---|---|
| Filed correctly within 30 days after the due date | “$60 per Form W-2 if you correctly file within 30 days after the due date; the maximum penalty is $698,500 per year ($244,500 for small businesses” |
| Filed correctly more than 30 days late but by August 1 | “$130 per Form W-2 if you correctly file more than 30 days after the due date but by August 1; the maximum penalty is $2,095,500 per year ($698,500 for small businesses)” |
| Filed after August 1, corrections not filed, or forms not filed | “$340 per Form W-2 if you file after August 1, do not file corrections, or do not file required Forms W-2; the maximum penalty is $4,191,500 per year ($1,397,000 for small businesses).” |
A reasonable cause defense exists: “The penalty will not apply to any failure that you can show was due to reasonable cause and not to willful neglect.”
Employee copies carry their own penalty: “The penalty applies if you fail to provide the statement by February 1, 2027, if you fail to include all information required to be shown on the statement, or if you include incorrect information on the statement.” “This penalty is an additional penalty and is applied in the same manner, and with the same amounts, as in Failure to file correct information returns by the due date, earlier.”
A payroll provider does not carry the responsibility for the employer: “Use of a reporting agent or other third-party payroll service provider does not relieve an employer of the responsibility to ensure that Forms W-2 are furnished to employees and that Forms W-2 and W-3 are filed with the SSA, correctly and on time.”
The edition read for this page is the 2026 General Instructions for Forms W-2 and W-3 and Form 8809 (Rev. December 2025), which are the revisions irs.gov served when they were read on 2026-10-17. The extended dates below are computed here by counting days from the printed due date and are not published by the IRS. Check the revision printed on the form you are filing, because a later revision can change the dates and the penalty amounts.
Common mistakes
- Treating the Form 8809 extension as automatic. The instructions say extensions to file Form W-2 are not automatic, are granted only in extraordinary circumstances or catastrophe, and must be requested before the due date.
- Assuming a granted extension also delays employee copies. The instructions say that even with an extension to file, Forms W-2 must still be furnished to employees by February 1, 2027, and a separate Form 15397 request is needed for more time to furnish.
- Letting a payroll provider own the date. The instructions say a reporting agent or third-party payroll provider does not relieve the employer of responsibility for correct and timely forms.
