Why Wisconsin has no estate tax

The Legislative Fiscal Bureau’s informational paper on the estate tax explains the mechanism: “the state estate tax was modified under 2001 Act 16”. For a specified period Act 16 linked the Wisconsin tax to the federal credit as computed before the 2001 federal changes. The Department says that for a death before 2008 you consult the Form W706 instructions.

Common mistakes

  • Using Wisconsin’s pre-2008 estate tax rules for a recent death; the Department says there is no estate tax for decedents dying after December 31, 2007.
  • Assuming the state answer settles the federal one, or the answer for property held in another state.
