Why Nevada has no estate tax
Chapter 375A of the Nevada Revised Statutes is titled Tax on Estates. The Department’s FAQ explains the design: “a tax is imposed in the amount of the maximum credit allowable” against the federal estate tax for state death taxes, and the NRS defines the federal credit as “the maximum amount of the credit against the federal estate tax”. The FAQ adds that Nevada will not require filing until the Internal Revenue Service reenacts the death tax credit.
Does Nevada have an inheritance tax?
The Nevada Constitution’s property-tax article says: “No inheritance tax shall ever be levied.” That is a constitutional bar, not a repeal.
CMG’s inheritance tax by state page covers the beneficiary side.
What applies to a Nevada estate instead
Federal estate tax is separate. Revenue Procedure 2025-32 says the One Big Beautiful Bill Act, section 70106, increased the “basic exclusion amount to $15,000,000 for calendar year 2026”.
An estate of $3,000,000 in Nevada owes $0 of state estate tax, and $3,000,000 is below the federal $15,000,000.
Probate: Nevada probate cost. Retirement accounts: how Nevada taxes 401(k) and IRA withdrawals.
Common mistakes
- Looking for a Nevada estate tax return after 2004; the Department says none is required unless the federal credit returns.
- Assuming the state answer settles the federal one, or the answer for property held in another state.
