Updated October 5, 2026. Quick answer: No. California has no estate tax for a person who dies in 2026. The State Controller’s Office says that for decedents who die on or after January 1, 2005, there is “no longer a requirement to file a California Estate Tax Return”. The federal exclusion is $15,000,000 for 2026.

Why California has no estate tax

The Controller’s page says the federal Economic Growth and Tax Relief Reconciliation Act of 2001 phased out the state death tax credit over a four-year period beginning January 2002, and that “Effective January 1, 2005, the state death tax credit has been eliminated”.

What applies to a California estate instead

Federal estate tax is separate. Revenue Procedure 2025-32 says the One Big Beautiful Bill Act, section 70106, increased the “basic exclusion amount to $15,000,000 for calendar year 2026”.

An estate of $3,000,000 in California owes $0 of state estate tax, and $3,000,000 is below the federal $15,000,000.

What the documents do not say

  • The Legislative Analyst’s primer is dated 2001; the Controller’s page is the current document for the filing rule.

Common mistakes

  • Assuming that no California estate tax means no tax on a California resident’s estate; the federal basic exclusion amount still applies.
  • Assuming the state answer settles the federal one, or the answer for property held in another state.
