Recapture

The statute makes the deduction “subject to recapture in the taxable years in which a distribution” is made for a reason other than qualified expenses, death, disability or a scholarship.

What the documents do not say

  • Whether excess contributions carry forward to a later year.
  • The Department of Revenue’s own guidance and the plan’s disclosure booklet could not be retrieved; the statute is the only source here.

What changes in 2026

No change for tax year 2026 appears in the statute text read for this page.

Federal rules

A state break sits beside the federal rules for 529 plans: the statute is 26 U.S.C. 529 and the IRS explains it in Publication 970, Tax Benefits for Education.

Common mistakes

  • Expecting a larger deduction because the contribution is large; the limit is per return.
