Updated September 24, 2026. Quick answer: An attorney-drafted revocable living trust in Alabama has a median price of $2,750, with the middle half of firms charging $2,250–$3,150 (LegalTemplates’ 2026 study of 909 law firms). That puts Alabama at the 18th-cheapest of the 21 states compared here, coming in over the $2,475 national median for a standalone trust. A DIY platform runs $149 to $649. What that spend buys locally: Alabama sets no single statewide probate filing fee. Jefferson County (Birmingham), the state’s most populous, charges $175.00 to probate a will and $57.00 to open an administration when there is no will.
Whether the state taxes the trust’s income is a separate question: does Alabama tax trust income.

What a living trust avoids: probate in Alabama
A living trust’s whole point is dodging what comes next: probate. Alabama would run the estate through the court process below, at the court’s own price, unless the assets are already titled in the trust’s name. Alabama sets no single statewide probate filing fee. Jefferson County (Birmingham), the state’s most populous, charges $175.00 to probate a will and $57.00 to open an administration when there is no will. Full filing-fee breakdown.
Alabama fixes one half of the bill by statute and leaves the other to the court: the personal representative’s compensation is ‘reasonable’ but capped at 2.5% of the value of all property received plus 2.5% of disbursements (Ala. Code §43-2-848), while attorney fees are reasonable with no percentage schedule. The second number is the small-estate threshold, at or under which an estate skips most of probate: $47,000, by summary distribution under Act 2025-431. Whether any of that reaches a solely owned house is answered below; it is where most published guidance goes wrong. Full Alabama probate cost guide, including the small-estate threshold that can skip probate without a trust at all.
Alabama living trust: signing, notary and the deed
Each line is a short extract quoted from, or a plain summary of, the statute cited; the section has the exceptions.
- Creating the trust. Ala. Code § 19-3B-402: “…the settlor indicates an intention to create the trust…”
- Writing rule. Ala. Code § 19-3B-407 (summarized, not quoted): a trust need not be evidenced by a trust instrument unless another statute requires one, but an oral trust and its terms can be established only by clear and convincing evidence.
- Certification of trust. Ala. Code § 19-3B-1013: “…the trustee may furnish to the person a certification of trust…”

Funding the trust in Alabama
A signed trust document is not the finish line: assets still have to be retitled into the trust’s name, and for a house that means a new deed. Alabama breaks the pattern here: its deed recordation tax is measured by the property’s actual value rather than the price stated on the deed, at fifty cents per five hundred dollars of value under Code of Alabama §§40-22-1 through 40-22-12 (Recordation Tax, Alabama Department of Revenue), and the statute carries no exemption written for a deed into the grantor’s own trust. Property assessments can also reset when ownership changes; the Department’s guidance on the new 7 percent assessment cap excuses only spousal and family no-consideration transfers and transfers at death, not trust funding by name (7% Cap Information, HB73/Act 2024-344, Alabama Department of Revenue). Recording still runs through the county probate judge’s office alongside tax payment.

Weigh the $2,750 against the probate cost above, plus what a dollar figure leaves out: privacy (a trust stays off the public court record) and a faster handoff to whoever inherits. The full worth-it analysis for Alabama works through the trade in detail for what real estate you own.
