Updated September 4, 2026. Quick answer. Virginia life insurance policies carry a free-look period of 10 days, and a grace period of not less than 31 days before a missed premium lapses the policy. If the insurer fails, Virginia’s life and health insurance guaranty association is the backstop, subject to statutory caps below.
The free-look period
10 days
Extended window: insurer may voluntarily extend beyond 10 days if the longer period is stated in the policy; industrial life carries the same 10 days
The grace period before a lapse
not less than 31 days
Coverage during the grace period: the policy continues in full force; the amount of any EARNED overdue premium or installment THROUGH THE POLICY MONTH OF DEATH, with interest, may be deducted from any amount payable in settlement
In short: premium deductible from proceeds · interest permitted.
If the insurer fails: the guaranty association limits
Virginia’s life and health insurance guaranty association is Virginia’s backstop if a life insurer becomes insolvent, but it pays up to a statutory cap, not the full policy value.
| Benefit | Limit |
|---|---|
| Death benefit | $300,000 |
| Cash surrender value | $100,000 |
Read the cap as a coinsurance percentage AND a dollar ceiling, whichever binds first, and many states apply both (commonly 80% of the contractual value, capped at a flat dollar figure), so a large policy can lose more than the percentage alone suggests.

Free-look: Va. Code Ann. Sec. 38.2-3301 (individual life); Sec. 38.2-3342 (industrial life), per the state’s insurance code; see the full 51-jurisdiction comparison and correction notes at the free-look table (read 2026-08-07). Grace period: Va. Code Ann. Sec. 38.2-3303 (individual life); Sec. 38.2-3343 (industrial life), read 2026-08-06 from statute. Guaranty limits: as published in the by-state guaranty-limits table, sourced there to the state’s guaranty act, read 2026-08-06. All three are compared across every state at the grace-period table and the guaranty-limits table.
Disclosed gap: the guaranty-limits figures above are reused from the by-state guaranty-limits table rather than re-derived from the statute section by section in this session. A spot check of one state’s cited link this session landed on the fund’s general powers section rather than the specific benefit-cap subsection, so the pinpoint citation may be one section off within the same guaranty-act chapter, even where the dollar figures match the near-uniform NAIC model-act minimums seen across the states checked directly.
This describes the general statutory rules; your specific policy may state different or additional terms. Not an offer of insurance and not legal advice.
