Indiana Life Insurance Rules: Free-Look, Grace Period, Guaranty Limits

Updated September 4, 2026. Quick answer. Indiana life insurance policies carry no general free-look mandate located for ordinary individual life insurance, and a grace period of not less than 30 days before a missed premium lapses the policy. If the insurer fails, Indiana’s life and health insurance guaranty association is the backstop, subject to statutory caps below.

The free-look period

Not established by a general statute for ordinary individual life insurance, per the sections read.

The grace period before a lapse

not less than 30 days

Coverage during the grace period: the insurance shall continue in force; if the insured dies within the grace period, the unpaid premium for the current policy year may be deducted in any settlement under the policy

In short: premium deductible from proceeds.

If the insurer fails: the guaranty association limits

Indiana’s life and health insurance guaranty association is Indiana’s backstop if a life insurer becomes insolvent, but it pays up to a statutory cap, not the full policy value.

BenefitLimit
Death benefit$300,000
Cash surrender value$100,000

Read the cap as a coinsurance percentage AND a dollar ceiling, whichever binds first, and many states apply both (commonly 80% of the contractual value, capped at a flat dollar figure), so a large policy can lose more than the percentage alone suggests.

Free-look: Ind. Code § 27-1-12-6 (standard provisions, contains no free look); 760 Ind. Admin. Code 1-18-10; 760 Ind. Admin. Code 1-24-5, per the sections read; see the full 51-jurisdiction comparison and correction notes at the free-look table (read 2026-08-07). Grace period: Ind. Code § 27-1-12-6, read 2026-08-06 from statute. Guaranty limits: as published in the by-state guaranty-limits table, sourced there to the state’s guaranty act, read 2026-08-06. All three are compared across every state at the grace-period table and the guaranty-limits table.

Disclosed gap: the guaranty-limits figures above are reused from the by-state guaranty-limits table rather than re-derived from the statute section by section in this session. A spot check of one state’s cited link this session landed on the fund’s general powers section rather than the specific benefit-cap subsection, so the pinpoint citation may be one section off within the same guaranty-act chapter, even where the dollar figures match the near-uniform NAIC model-act minimums seen across the states checked directly.

Disclosed gap: the source hub flags this state’s grace-period citation with a currency caveat: the text was read verbatim but the publishing surface’s own currency against the legislature’s site could not be independently confirmed in that build. Verify the section before relying on it.

This describes the general statutory rules; your specific policy may state different or additional terms. Not an offer of insurance and not legal advice.
