Delaware Life Insurance Rules: Free-Look, Grace Period, Guaranty Limits

Delaware life insurance policies carry no general free-look mandate located for ordinary individual life insurance, and a grace period of 30 days, or at the insurer’s option 1 month of not less than 30 days; 4 weeks for industrial life insurance policies whose premiums are payable more frequently than monthly before a missed premium lapses the policy. If the insurer fails, Delaware’s life and health insurance guaranty association is the backstop, subject to statutory caps below.

The free-look period

The grace period before a lapse

Delaware’s life and health insurance guaranty association is Delaware’s backstop if a life insurer becomes insolvent, but it pays up to a statutory cap, not the full policy value.

Read the cap as a coinsurance percentage AND a dollar ceiling, whichever binds first, and many states apply both (commonly 80% of the contractual value, capped at a flat dollar figure), so a large policy can lose more than the percentage alone suggests.
