Homestead Exemption in North Dakota: $150,000 Flat

This is protection against an ordinary money judgment creditor under North Dakota Century Code §§ 47-18-01, 47-18-03, 47-18-04, 47-18-05, 47-18-16, 47-18-17, a different question from a property tax bill or exemption, which this page does not cover.

How it works in North Dakota

  • No filing required. A declaration may be filed, but a failure to file one does not impair the homestead right.
  • Married couples and joint owners: One shared homestead scheme; if the claimant is married, the homestead may be selected from either spouse’s separate property with the other spouse’s consent, and conveying or encumbering it requires both spouses’ signatures regardless of value.

If you sell the home

If the homestead is sold to satisfy a lien or conveyed under the joint-consent rule, the sale price or proceeds beyond what’s needed to satisfy the lien (capped at the homestead exemption amount) keep the same protection for one year from the conveyance date.

What it does not protect against

Mechanics’/construction/laborers’ liens for work on the property, mortgages executed and acknowledged by both spouses (or the unmarried claimant), purchase-money debts and taxes, and (on appraisal) any other debt once the homestead’s value is shown to exceed $150,000 over liens.
