Updated August 27, 2026. Quick answer: Texas uses a daily divisor of $262.37, effective September 1, 2025, for case actions disposed on or after that date. The previous rate, $242.13, had been in place since September 1, 2023.
The figure Texas publishes
| What the state lists | Figure |
|---|---|
| Effective Sept. 1, 2025 | $262.37 per day |
| Effective Sept. 1, 2023 | $242.13 per day |
| Effective Sept. 1, 2021 | $237.93 per day |
| Effective Sept. 1, 2019 | $213.71 per day |
How the penalty period is calculated
- Divide the uncompensated value by the daily transfer of assets divisor in effect for the date the case action was disposed.
- Round down partial amounts to the whole number of days. The result is the number of days in the penalty period.
- Texas reviews the daily rate every other year, so the figure changes on a two-year cycle rather than annually.
Once you have the figure above, the Medicaid penalty period calculator does the arithmetic. This page is the Texas rate record; the calculator is the class parent.
What this page does not settle
- The divisor that applies is fixed by the date the case action was disposed, not by the date of the transfer itself.
- The handbook lists rates back to November 1, 2005; only the four most recent are reproduced here.
Eligibility is decided by the state agency on the whole file, not by this one number. Nothing here is legal advice, and no one should transfer, retitle or give away property on the strength of a worksheet.
