Updated August 10, 2026. Quick answer. Texas life insurance policies carry no general free-look mandate located for ordinary individual life insurance (see the extended-window exception below), and a grace period of one month (at least) before a missed premium lapses the policy. If the insurer fails, Texas Life and Health Insurance Guaranty Association is the backstop, subject to statutory caps below.
The free-look period
Not established by a general statute — see notes (No right-to-examine / free-look provision exists in Tex. Ins. Code ch. 1101 (‘Life Insurance Policies’), which is the chapter that governs the contents of individual life policies. Its enumerated required provisions are )
The grace period before a lapse
one month (at least)
Runs from: the due date of each premium after the first.
Coverage during the grace period: the policy remains in force; the policy may provide that overdue premiums are deducted from any settlement if the insured dies during the grace period, or alternatively that interest is charged on the late payment
If the insurer fails: the guaranty association limits
Texas Life and Health Insurance Guaranty Association is Texas’s backstop if a life insurer becomes insolvent — but it pays up to a statutory cap, not the full policy value.
| Benefit | Limit |
|---|---|
| Death benefit | $300,000 |
| Cash surrender value | $100,000 |
Read the cap as a coinsurance percentage AND a dollar ceiling, whichever binds first — many states apply both (commonly 80% of the contractual value, capped at a flat dollar figure), so a large policy can lose more than the percentage alone suggests.
