Does a Power of Attorney Work in Another State?

Updated August 3, 2026. Quick answer: usually yes, and “usually” is doing real work in that sentence. Most states will recognise a power of attorney validly executed elsewhere — but recognition by law and acceptance by a bank branch are different problems, and it is the second one that stops people.

The legal answer

States that have adopted the Uniform Power of Attorney Act carry a recognition provision: a power of attorney executed in another state is valid if it met the law of the place where it was executed. Of the jurisdictions verified here, 23 are confirmed Uniform Act adoptions.

But the Act is not universal, several adopting states changed it materially, and a few large states never adopted it at all. So the honest general answer is that portability is the normal case rather than a guarantee.

Where portability actually breaks

  • The document does something the new state treats differently. Real-estate transactions are the common one, because recording requirements are local and a power that was never notarised may be fine for a bank and useless for a deed.
  • Durability defaults differ. A document that relied on being durable by default in its home state can meet a state that requires the words — and two Uniform Act states reverse the default in exactly that way. Which states require the language.
  • The institution simply refuses. The most common failure by a wide margin, and not really a portability question at all.

The practical answer, which is different

A bank in the new state has no way to know the law of the old one and every incentive to ask for something it recognises. That is why the useful step when you move is not legal research — it is signing a fresh power of attorney under the new state’s rules, which costs little and removes the argument entirely.

Keep the old one until the new one is signed and accepted. There is no reason to have a gap.

Several states impose a deadline to accept or give reasons, with a court order and attorney’s fees for wrongful refusal — and the windows differ: most verified states use 7 business days, while Nevada, Texas, Wisconsin and South Dakota use 10. The acceptance statutes and the remedy.
